Open seats for Kindergarten-12th grade will be published after May 1, 2024. Application forms for Out-of-District waiver requests will be available June 1-June 30, 2024. Requests will be received, approved and placed on a lottery basis, according to space availability no later than July 15, 2024. The Derby Public Schools Board of Education also approved that after non-resident approval and enrollment occur, all non-resident students will need to be screened for academic performance in reading, math and science.

Placement of Students: Non-resident students accepted for enrollment will be placed in schools by the administration according to open seats based upon the capacity recommendations. Requests for specific schools may not be honored, except for employees who have children who request to attend the building the employee is assigned to work.

KSHSAA Eligibility: Nothing in this policy or state law shall exempt a non-resident student who transfers into the district from the requirements of the Kansas State High School Activities Association (“KSHSAA”) regarding eligibility to participate in KSHSAA activities.

Transportation of Non-Resident Students: The district will not provide transportation to non-resident students unless otherwise required to do so by state and/or federal law, as a related service through a student’s individualized education program (IEP) or student’s Section 504 plan accommodation.
Any exception may be approved on a case-by-case basis by the Superintendent of Schools or designee.
